2. Eligibility

• Only bona fide organisations and their authorised representatives may register and use the Portal.
• Users must be at least 18 years old and legally capable of entering into binding contracts.
• Registration requires submission of a valid User Authorisation Letter on official letterhead.

3. Account Registration and Use

• Each organisation must designate one or more Authorised Users as primary points of contact.
• You are responsible for maintaining the confidentiality of your login credentials.
• All information provided must be true, accurate, and kept up to date.
• Notify us immediately of any unauthorised use of your account.

4. Permitted Use

The Portal enables stakeholders to:

• Showcase products, services, and capabilities through marketplace listings
• Collaborate with other stakeholders
• Access information, knowledge hubs, and project development tools
• Promote indigenous technologies and support the National Green Hydrogen Mission

5. Prohibited Activities

You shall not:

• Impersonate any person or entity or misrepresent your affiliation
• Upload false, misleading, defamatory, obscene, or unlawful content
• Upload viruses, malware, or disrupt the Portal's operation
• Use the Portal for spamming, phishing, or unauthorised marketing
• Reproduce, copy, or exploit the Portal for unrelated commercial gain
• Attempt unauthorised access to systems, data, or other user accounts

6. Content Ownership

• You retain ownership of content you submit. By uploading, you grant us a non-exclusive, royalty-free, worldwide license to use and display such content.
• You are responsible for ensuring your content is accurate, lawful, and does not infringe on third-party rights.
• We reserve the right to review, moderate, or remove content that violates these Terms.

7. Intellectual Property

All intellectual property rights in the Portal are owned by or licensed to Excelvate Systems Pvt. Ltd. You are granted a limited, non-transferable license to use the Portal for its intended purpose only.

8. Data Protection & Privacy

Your use of the Portal is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

9. Portal Availability

We strive to provide uninterrupted access but do not guarantee the Portal will always be available, error-free, or secure. We may modify, suspend, or discontinue any part of the Portal at any time.

10. Disclaimer of Warranties

The Portal is provided on an "as is" and "as available" basis. We make no warranties regarding:

• Accuracy, completeness, or reliability of content
• Suitability for your specific purposes
• Continuous, secure, or error-free access

11. Limitation of Liability

To the maximum extent permitted by law, Excelvate Systems Pvt. Ltd. shall not be liable for any damages arising from your use or inability to use the Portal, including business losses, lost profits, or loss of data.

12. Indemnification

You agree to indemnify and hold harmless Excelvate Systems Pvt. Ltd. from any claims, liabilities, or expenses arising from your use or misuse of the Portal, or violation of these Terms.

13. Termination

We may suspend or terminate your access at any time if you violate these Terms or submit false information. Upon termination, your right to use the Portal ceases immediately.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra.
